Children Legislation Amendment (Wood Inquiry Recommendations) Act 2009, New South Wales


The Children Legislation Amendment (Wood Inquiry Recommendations) Act 2009 had the full title: An Act to amend the Children and Young Persons (Care and Protection) Act 1998 and other legislation to give effect to recommendations of the Special Commission of Inquiry into Child Protection Services in NSW; and for other purposes. This Act was part of the Government’s response to the 2008 Report from a Special Commission of Inquiry led by Justice Wood (not to be confused with the 1995-1997 Wood Royal Commission into the NSW Police). This legislation raised the threshold for statutory intervention in child reporting to ‘risk of significant harm’, to clarify the working of the Out of Home Care (OOHC) system to focus on the children most at need of care, and to make changes to increase the sharing of information between Government agencies.
